The terms and conditions governing your use of the BYOP Electric website and services.

These Terms of Service ("Terms") govern your access to and use of the website byopelectric.com (the "Site") operated by BYOP Electric ("we," "us," or "our"), a DBA of BYOPower. Please read these Terms carefully before using the Site.

1. Acceptance of Terms

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Site. We reserve the right to modify these Terms at any time. Your continued use of the Site after any changes constitutes acceptance of the revised Terms.

2. Description of Services

BYOP Electric is a licensed electrical contractor (Utah License #13906594-5501) providing solar panel installation, battery storage, EV charger installation, and residential electrical services across Utah's Wasatch Front. The Site provides information about our services, allows you to request quotes, and provides educational content about electrical and solar energy topics.

The information on this Site is for general informational purposes only and does not constitute professional electrical engineering advice for your specific situation. Every property and project is different, and a proper assessment is required before any work begins.

3. Quotes and Estimates

Any quotes, estimates, or pricing information provided through the Site, by email, by phone, or in person are for informational purposes only and are not binding until a written service agreement is signed by both parties. Quotes are subject to change based on:

  • Site inspection findings
  • Changes in material costs
  • Changes in project scope
  • Permitting requirements
  • Utility interconnection requirements
  • Structural or electrical conditions discovered during installation

All quotes have an expiration date as stated on the quote document. After expiration, pricing may be updated to reflect current material and labor costs.

4. Service Agreements

Actual electrical contracting services are governed by separate written service agreements between you and BYOP Electric. These Terms do not replace, modify, or supplement any service agreement. In the event of a conflict between these Terms and a signed service agreement, the service agreement shall prevail.

5. Licensing and Compliance

BYOP Electric is licensed by the State of Utah Department of Professional Licensing (DOPL) as an E200 Electrical Contractor. All work is performed in compliance with the NEC 2023 (as adopted by Utah), local building codes, and utility interconnection requirements. We maintain general liability insurance and workers' compensation coverage as required by Utah law.

6. Intellectual Property

All content on the Site — including but not limited to text, graphics, logos, images, photographs, videos, blog posts, system designs, and software — is the property of BYOP Electric or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not:

  • Reproduce, distribute, or publicly display any content from the Site without our prior written consent
  • Use our trademarks, trade names, or logos (including the BYOP and B.Y.O.P marks) without our prior written consent
  • Modify, adapt, or create derivative works based on our content
  • Use any content from the Site for commercial purposes without our permission

7. User Submissions

When you submit information through our contact forms, quote request forms, or other means, you grant us permission to use that information to:

  • Respond to your inquiry
  • Provide the requested services
  • Follow up regarding your project
  • Send relevant service information

You represent that any information you submit is accurate, current, and complete. You agree not to submit any information that is false, misleading, defamatory, or unlawful. We handle all submitted information in accordance with our Privacy Policy.

8. Prohibited Uses

You agree not to use the Site to:

  • Violate any applicable laws or regulations

  • Transmit any viruses, malware, or other harmful code
  • Interfere with or disrupt the Site or its servers

9. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Site will be uninterrupted, secure, or error-free
  • Any information on the Site is complete, accurate, or current
  • Any defects will be corrected
  • The Site is free of viruses or other harmful components

Any information regarding energy savings, solar production, battery performance, or financial returns presented on the Site are estimates only and are not guarantees. Actual results depend on many factors including weather, utility rates, system sizing, orientation, shading, and usage patterns.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BYOP ELECTRIC, ITS OWNER, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, INCLUDING BUT NOT LIMITED TO:

  • Loss of data or profits
  • Business interruption
  • Reliance on information provided on the Site
  • Unauthorized access to or alteration of your transmissions or data

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00). This limitation does not apply to liability arising from signed service agreements, which are governed by their own terms.

11. Indemnification

You agree to indemnify, defend, and hold harmless BYOP Electric, its owner Batsaikhan Ariun-Erdene, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Site
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Any content you submit through the Site

12. Third-Party Links

The Site may contain links to third-party websites or services that are not owned or controlled by BYOP Electric. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites. You acknowledge and agree that we are not responsible or liable for any damage or loss caused by the use of any such websites.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Utah County, Utah, and you consent to the personal jurisdiction and venue of such courts.

14. Dispute Resolution

Before filing any claim or lawsuit, you agree to first contact us at contact@byopelectric.com and attempt to resolve the dispute informally for at least 30 days. If the dispute cannot be resolved informally, either party may pursue legal remedies as described in the Governing Law section above.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BYOP Electric regarding your use of the Site. These Terms do not govern any electrical contracting services, which are subject to separate written agreements.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Material changes may be communicated through a notice on the Site. Your continued use of the Site after any changes constitutes acceptance of the new Terms.
